NOTICE: THIS PRIVACY POLICY CONTAINS A MANDATORY ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, AS DESCRIBED IN SECTION 13 BELOW, WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ THIS PRIVACY POLICY CAREFULLY.
1. Purpose
Borer Newman LLC, doing business as Amber Health (“Amber Health,” “Amber,” “we,” “us,” or “our”), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you access our website at www.amber.health (the “Site”), or otherwise interact with Amber Health in connection with our non-clinical mental health wellness facilitation, education, and related consulting services (collectively, the “Services”).
The Services are non-clinical and are not intended as a substitute for professional medical, mental health, or other licensed advice, diagnosis, or treatment. Please review our Terms of Use for a full description of the non-clinical nature of the Services.
2. Acceptance of This Privacy Policy
By accessing or using the Site or Services, you acknowledge that you have read and understand this Privacy Policy and our Terms of Use, which is incorporated herein by reference. Information about you may be collected, used, and disclosed as described in this Privacy Policy.
3. Information We May Collect
Personal Information. We may collect personal information that you voluntarily provide, such as your name, email address, phone number, mailing address, payment information, and other information you choose to share. Depending on the Services requested, we may also collect information you voluntarily share in connection with wellness facilitation, coaching, or related consulting, such as goals, circumstances, and other information relevant to providing the Services.
Amber Health is a non-clinical mental health wellness and consulting business and is not a covered entity or business associate under the Health Insurance Portability and Accountability Act (“HIPAA”). HIPAA does not govern our collection, use, or disclosure of information; our privacy practices are described in this Privacy Policy and, for individuals receiving Services, in the applicable Participant Informed Consent. We collect this information only when you voluntarily provide it, and we use it for the purposes described in this Privacy Policy.
Non-Personal Information. We may automatically collect certain non-personal information when you visit the Site, including information about your browser, device, IP address, operating system, referring website, pages viewed, and dates and times of access. We use this information to operate, secure, and improve the Site and Services.
4. How We Use Your Information
We use the information we collect only as necessary to provide, operate, and improve the Site and Services. Specifically, we may use your information to present the Site and its content to you; provide the Services you request; schedule and administer consultations, workshops, or programs; process payments; communicate with you regarding your participation, questions, or requests; send administrative communications, including updates to this Privacy Policy or our Terms of Use; protect the security and integrity of the Site and our business; and comply with applicable legal and regulatory requirements.
We do not sell, rent, or trade your personal information for third-party marketing or advertising purposes.
5. How We Share Your Information
We may share your information with trusted third-party service providers who assist us in operating our business, such as website hosting providers, scheduling platforms, client management systems, payment processors, video conferencing platforms, and email communication services. These parties are required to protect your information in a manner consistent with this Privacy Policy and to use it only to provide services to us.
We may also disclose your information to comply with a court order, law, legal process, or government or regulatory request; to enforce or apply our Terms of Use or other applicable agreements, including for billing purposes; if we believe disclosure is necessary to protect the rights, property, or safety of Amber Health, our personnel, our clients, or others; to a buyer or successor in connection with a merger, acquisition, financing, reorganization, or sale of some or all of our assets; or with your consent, or to fulfill the purpose for which you provided the information. We will not disclose your personal information to third parties for their own marketing purposes without your consent.
Borer Newman, LLC does not share mobile numbers, text messaging originator opt-in data, or consent with any third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
6. Cookies and Tracking Technologies
The Site may use cookies and similar tracking technologies to operate, secure, and improve the Site, and to understand how visitors use it. Cookies are small data files placed on your device when you visit the Site. We may use these technologies for analytics, to remember preferences, and to support the technical functions of the Site.
You may disable cookies through your browser settings; doing so may affect the functionality of portions of the Site. Where applicable law requires it, we will provide a mechanism to opt out of non-essential tracking technologies.
7. Confidentiality and Security
We recognize that information you or a Participant may share with Amber Health in connection with the Services including information relating to personal circumstances, goals, or wellbeing is sensitive. We treat such information as confidential and maintain reasonable administrative, technical, and physical safeguards designed to protect it from unauthorized access, use, or disclosure.
Where Services are provided under a Services Agreement or Participant Informed Consent, Participant-specific session notes, records, and communications are treated as confidential and are not shared with a Client (as defined in the applicable agreement) except in aggregated or de-identified form or as otherwise required by applicable law. Please refer to the applicable Services Agreement and Participant Informed Consent for additional detail regarding confidentiality practices and limitations, including circumstances in which disclosure may be necessary to address safety concerns.
Although we use reasonable safeguards to protect your information, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Rights and Choices
You may request access to, or a copy of, the personal information we hold about you, and you may request that we correct inaccurate or incomplete information. You may opt out of receiving promotional or marketing communications at any time by following the unsubscribe instructions in our emails; we may still send administrative communications, such as updates to this Privacy Policy, even if you opt out of marketing communications. To exercise any of these rights, please contact us using the information in Section 12 below.
9. International Users and Cross-Border Data Transfers
Amber Health is based in the United States. If you access the Site or receive Services from outside the United States including, for example, touring musicians, crew, or other individuals located in the United Kingdom or elsewhere you acknowledge that your personal information may be collected, stored, and processed in the United States, and may be accessed by Amber Health personnel while traveling or working outside the United States. We maintain reasonable administrative, technical, and physical safeguards to protect your information regardless of where it is accessed or processed.
Depending on your country or state of residence, you may have additional rights regarding your personal information under applicable law, including rights to access, correct, delete, or restrict the processing of your personal information, or to object to certain processing. We will respond to verifiable requests in accordance with applicable law. To make such a request, please contact us using the information in Section 12 below.
10. Children's Privacy
The Site is not directed to, and is not designed for use by, children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected personal information from a child under 13 without the consent of a parent or guardian, we will delete that information as soon as reasonably practicable. If you believe we may have collected information from a child in violation of this Policy, please contact us using the information in Section 12 below.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, Services, or applicable law. Updates will be posted on the Site with a revised effective date. Your continued use of the Site or Services following any posted update constitutes your acknowledgment of the revised Privacy Policy.
